A British pharmaceutical company tried for patenting Ginger. Instant action by the Indian authorities and timely intervention led the Patent authority to strike down the claim. Ginger is widely used in the Indian cuisine and appreciated for its medicinal properties. Ginger is the main ingredient for all spicy foods for which India is famous for. The patent application (GB2436063) titled as `Pharmaceutical composition for the treatment of excess mucous production’ was submitted by Larkins Nicholas John, on 16th March 2006. The patent claimed that the company had found a unique finding in the utility of ginger. The patent application was struck down upon scrutiny of evidence provided by CSIR and department of AYUSH. The evidences provided includes age-old scripts such as Al Qaanoon-fil-Tibb, 1996; Khazaain-al-Advia', 1926; Rasaratnasamuccay', 2000; Brhat Nighantu Ratnäkara', 1996; Cakradattah', 2002; Bhaisajva Ratnävali', 2001 and Bhärata Bhaisajya Ratnäkara', 1999. The ingredient Gingerol, mentioned in this application, is an active constituent in fresh ginger which is, since decades, being used in the treatment of cold and reduction of mucous production in India.
